Ouya dev consoles shipping to backers on December 28th, SDK available same day

Developer kits for the Ouya were given a ship date of December 28th today, alongside news that the system's software development kit ("ODK") will be available that same day. In case it wasn't already clear how small the Android-powered console is, the folks at Ouya included the picture you see above to further illustrate that point -- the thing is really small. Ouya expects the dev kits to get into backers' hands "within a couple days" of the 28th. Final units are still intended to ship some time in March 2013, though no final date is available just yet.

How different are these dev units from the final run, though? Not that different, we'd guess, considering the company's continued promise that "every Ouya will be a dev console." The only hint given of their difference is a note in today's update calling them, "pretty special." Beyond just getting a jump on game development with the Ouya in mind, dev unit buyers will also be the first to try out Jelly Bean gaming. Of course, if you're a dev unit-level backer and you'd like to share your thoughts with us, we're all ears.

The window to bring Double-A baseball to Ottawa has been extended into early 2013, Mayor Jim Watson said in a memo to city council Wednesday.

According to Watson, Beacon Sports Capital Partners, the group negotiating the purchase, asked for the extension ?given the complexity of the commercially confidential discussions still under way with a number of parties.?

Watson said he ?remain(s) optimistic? that a deal can be reached within the first quarter of the new year, in time to bring professional baseball back to the vacant Ottawa Stadium for the 2014 season.

Negotiations have been ongoing between the city, the Beacon group and the Eastern League, where it has long been rumoured the floundering Binghamton Mets, Double-A affiliate of the New York Mets, will be sold.

On Tuesday, Beacon COO Richard Billings shot down an ESPN report that suggested the sale of the Binghamton franchise to Ottawa had ?fallen through,? saying the report was ?inaccurate? and that negotiations are indeed continuing.

Binghamton Mets president Michael Urda has denied his team is on the move.

Eastern League president Joe McEacharn did not return requests for comment.

David Gourlay, founder of the Champions for Ottawa Baseball group building community support for the team, said the search for local ownership partners remains a key sticking point in negotiations, and could be a ?deal-breaker.?

The baseball winter meetings, starting Monday in Nashville, were thought to be a crucial point in the timeline to finalize a deal. However, Billings said the meetings are not a ?hard? deadline.

?When there is a final agreement with Beacon Sports Capital Partners and the Eastern League, I will update members of council at the earliest opportunity,? said Watson.

Court: 1-year suspension for Ohio St. case lawyer

COLUMBUS, Ohio (AP) ? The Ohio Supreme Court on Wednesday suspended for one year the law license of an attorney whose emails to Jim Tressel triggered an ongoing scandal and NCAA investigation that cost the football coach his job at Ohio State University.

At issue was whether Columbus attorney Christopher Cicero violated professional rules of conduct that prohibit revealing information from meetings with a client or a prospective client.

The 5-2 court decision followed the recommendation of a disciplinary board that argued Cicero wrongly discussed interviews with tattoo parlor owner Edward Rife, a potential client. However, the court overruled the board's recommendation for a six-month suspension.

Cicero sent emails to Tressel in April 2010, warning him that players were selling memorabilia or trading them for tattoos. The email traffic sparked the scandal and ended Tressel's Ohio State tenure.

An NCAA investigation also led to a bowl ban this year, reductions in scholarships and the loss of Ohio State's $389,000 share of the Big Ten bowl pot a year ago. The entire 2010 season also was vacated.

Ohio State just completed a 12-0 season and is ranked No. 4 in the AP poll.

Justice Judith Lanzinger said the case went to the heart of the importance of confidentiality between a prospective client and an attorney.

"Prospective clients trust that their confidences will be protected when they engage in an initial consultation with an attorney," Lanzinger wrote. "Cicero's almost immediate dissemination of the detailed information that Rife provided on April 15 directly violated that trust."

Justices Evelyn Lundberg Stratton and Terrence O'Donnell dissented, saying they would have imposed a six-month suspension.

"Cicero's intentions were not for personal aggrandizement or personal gain, as found by the majority, but were to alert the coach about misconduct by his players that could affect the team," Stratton wrote.

"His request that such information be held confidential does not support the notion that he was trying to seek fame," she said.

Cicero's lawyer said he was disappointed with the decision, saying he and his client had considered even a six-month suspension "a little harsh."

"We ended up losing for a year a really, really great lawyer who practices in a difficult area ? felony criminal law," said attorney John Gonzales.

He didn't know Cicero's plans for the year, adding they hadn't expected the decision so soon.

Cicero met with Rife on April 2, 2010, according to court documents, and again 13 days later to discuss whether Cicero would represent him in a federal drug trafficking case, according to a complaint against him by the Disciplinary Counsel of the Ohio Supreme Court.

Cicero, an Ohio State football player in the early 1980s, denied meeting with Rife on April 2. He said the two did meet on April 15, 2010, with the goal of confirming that Rife's partner, a former client of Cicero, wasn't involved with drug dealing or memorabilia sales.

Rife's house had been raided April 1 by federal drug investigators and Cicero wanted to know if Joseph Epling, his client and Rife's business partner, was involved in the case.

"Eddie Rife was never going to be my client in this case at all," Cicero told a three-member disciplinary panel at the Ohio Supreme Court last year. "I saw him as an ally and resource for Mr. Epling. That's how I viewed Mr. Rife's purpose in my office."

Rife pleaded guilty to drug trafficking and money laundering last year and was sentenced to three years in prison.

It was emails Cicero sent to Tressel in April 2010, warning him that players were selling memorabilia or trading them for tattoos, that helped launch the scandal.

In those emails, Cicero seemed to make it clear that he may have taken on Rife as a client.

"If he retains me, and he may, I will try to get these items back," Cicero wrote in an April 16, 2010, email.

"I have to sit tight and wait to see if he retains me, but at least he came in last night to do a face to face with me," Cicero wrote later that day.

Cicero and his attorneys argued the emails sent to Tressel were only meant to warn the coach about his players' actions and shouldn't be read as a breach of confidentiality, since ?they argued ? Rife was not a client.

Ohio's legal conduct rules generally prohibit attorneys from divulging any information they received from someone who might be a prospective client.

News of the memorabilia sales emerged in December 2010. In March 2011, the university discovered that Tressel had known about the sales since the previous April and said nothing. That was a violation of both NCAA rules and Tressel's contract, which required the prompt reporting of any knowledge of such player infractions. Tressel resigned under pressure in May 2011.

3 Renewable-Energy Nanotech Projects to Watch

According to three studies published in the journal?Technology and Innovation ? Proceedings of the National Academy of Inventors, nanotechnology research being conducted in Florida could improve energy efficiency in several different applications.

One such project, which is being developed by researchers at the Southeast National Marine Renewable Energy Center at Florida Atlantic University, will attempt to use the energy in ocean waves and current, Phys.org reported. Through research and development of materials and marine current turbines, great advances in harnessing the ocean's kinetic energy can be made, according to researchers.

Another project, which is being developed by engineers from the University of South Florida's Clean Energy Resource Center, attempted to use ?rectenna? devices to convert waste heat into electrical energy. These devices capture thermal radiation, which oftentimes is an overlooked source of renewable energy, according to Phys.org. Rectennas, which are a combination of an antenna and a tunnel diode, could be more efficient than solar power if the technology is made to be more efficient.

Physicists from the University of South Florida are looking at ways to use nanotechnology in greenhouses to improve energy efficiency. For use in hydroponic agriculture, a new lighting device -- called a nanophosphor-based electroluminesence lighting device --?could be used to create precise wavelengths of light required for indoor photosynthesis, eliminating wasted energy and saving growers money.

Merkel's election schedule weighs on Greek bailout

BERLIN (AP) ? German Chancellor Angela Merkel's upcoming re-election battle is shaping Europe's response to bailing out debt-ridden Greece.

Her strategy: Do just enough to keep Greece afloat but spare German voters ? for now ? the news that even more of their money will be required to get the Greeks back on their feet.

Merkel has led Europe's biggest economy since 2005. The greatest risk to her re-election bid, pollsters and analysts say, is a dramatic worsening of Europe's debt crisis ? such as Greece exiting the eurozone, or a Greek debt write-off costing billions in German taxpayer money.

A deal reached Tuesday by the 17 nations that use the euro is a patchwork of measures to plug new shortfalls in Greece's budget and trim its debt load over the coming years. But it stopped short of forgiving some of the country's debt ? having eurozone creditors like Germany take a so-called "haircut."

"Greece's debt is not sustainable, even with the new measures, so the problem will be back in 2014 at the latest," said Christoph Weil, an economist with Commerzbank.

But losing more money on rescuing the Greeks and other economically weak European Union nations could be politically toxic in Germany, where Merkel faces a national election in September. So far, Merkel's hard-nosed approach to Europe's debt crisis has bolstered her popularity at home.

"Ms. Merkel doesn't want to stand in front of her voters and tell them that the Greek rescue will cost taxpayers a couple of billions," Weil added.

Many economists say that Greece's debt burden ? forecast to reach some 190 percent of gross domestic product next year ? can only be managed by writing off more government loans. But Merkel and German Finance Minister Wolfgang Schaeuble were the most outspoken opponents of such a step, instead insisting on austerity measures and structural reforms.

"A haircut is urgently necessary. This constant strategy of muddling through instead of tackling the problem won't work in the long run," Weil said.

Greece is currently heading into its sixth consecutive year of a deep recession with unemployment hovering around 25 percent.

Tuesday's deal forecasts that Greece's debt will shrink to 124 percent in 2020 and "sustainably less" than 110 percent only two years later. Many private economists call those projections wishful thinking, saying they are based on overly optimistic budget and growth assumptions ? especially with the overall eurozone now in recession.

Recent German public opinion surveys consistently show Merkel's conservative bloc as the country's strongest party, though her junior coalition partners, the pro-business Free Democrats, are struggling, possibly jeopardizing her ability to form a new coalition government.

Neither Merkel's coalition nor the two main opposition parties are currently seen as winning a clear majority to form a government.

Analysts have estimated that a full-fledged haircut on Greek rescue loans could cost Germany, the main contributor to the bailouts, up to ?17 billion ($22 billion) ? more than 5 percent of Berlin's annual budget.

The mass-circulation daily Bild, never a fan of bailing out Athens, asked in a headline Wednesday: "Will this never stop? Yet more billions for Greece."

"I say that a haircut hasn't been avoided ? it has been delayed until a time after the parliamentary election," said Frank-Walter Steinmeier, a leader of the main opposition Social Democrats.

He says Merkel's government was concealing the truth for fear of being punished at the polls. Other German lawmakers agreed.

"One must get the impression that the German voting schedule was more important here than the basics of math," said Priska Hinz of the opposition Greens party. "It remains unclear how Greece can return to financial markets and how that is to be financed."

In rejecting of a debt write-off, the government "shies away from telling its people the truth and clearly say that keeping Greece in the eurozone does not only make sense but will also have a cost," she added.

Still, Germany's opposition is expected to join the government in approving the Tuesday deal to make sure Greece doesn't go bankrupt and abandon the euro. Parliament is expected to vote on Friday.

For his part, Schaeuble rejected the claims that Germany's response to the Greek crisis was being driven by the election calendar. Instead, he defended the Tuesday deal, saying it leaves no doubt that Greece must first implement austerity measures and structural reforms for the bailout to work.

But Schaeuble acknowledged that the new measures for Greece not only consist of loans but might cost Germany up to ?730 million ($950 million) next year alone.

Ulrich Kater, the chief economist of Germany's DekaBank, said it was understandable that the German government didn't want to make far-reaching decisions ahead of an election.

"That shows how difficult it is to manage the eurozone, with its 17 nations where there's always an election looming somewhere," he said.

BRUSSELS (Reuters) - Euro zone finance ministers and the International Monetary Fund clinched agreement on reducing Greece's debt in a breakthrough to release urgently needed loans to keep the near-bankrupt economy afloat.

After 12 hours of talks at their third meeting in as many weeks, Greece's international lenders agreed on a package of measures to reduce Greek debt by 40 billion euros, cutting it to 124 percent of gross domestic product by 2020.

Following are comments after their talks:

FRENCH FINANCE MINISTER PIERRE MOSCOVICI

"We made progress with solutions that are realistic. Everyone has gone beyond their red lines, driven by a common interest to find credible solutions for the integrity of the euro zone."

GERMAN FINANCE MINISTER WOLFGANG SCHAEUBLE

ON PAYMENT OF AID TRANCHE TO GREECE:

"We will make the final decision about the payment of the tranche after the conclusion or result of a possible debt buyback program."

ON POSSIBLE FURTHER MEASURES TO CUT GREEK DEBT:

"When Greece has achieved, or is set to achieve, a primary surplus and fulfilled all of its conditions, we will, if need be, consider further measures for the reduction of the total debt."

EUROGROUP PRESIDENT JEAN-CLAUDE JUNCKER

ON GOAL AND POSSIBILITY OF FURTHER MEASURES:

ON DISBURSEMENTS AND CONDITIONS:

"This includes a set of stronger budgeting and monitoring rules, this includes the establishment of a strengthened and fully transparent segregated account for debt servicing and this does include the disbursements from the EFSF (temporary bailout fund) in the first quarter of 2013, which will be made in three tranches linked to the implementation of conditionality milestones to be agreed by the troika.

"We also consider that as part of the recapitalization of Greek banks, remaining subordinating debt totals of these banks should participate in this process in order to achieve a fair burden-sharing. We were informed that Greece is also considering certain debt-reduction measures in the near future which may involve public debt tender purchases of one or more of the various categories of sovereign obligations."

ON IMPROVING SUSTAINABILITY OF GREEK DEBT:

"On the part of the other euro member states, crucial decisions were made to enhance Greece's debt sustainability and its overall debt profile in the spirit of European solidarity and common faith in Greece's future in the euro area.

"Let me just mention a few:

* The lowering of the interest margin on the bilateral loans granted in 2010/2011 to the low level by a further 100 basis points

* an extension of the maturities of all loans provided to Greece by 15 years, and

* a deferral of the interest payments by Greece on EFSF loans by 10 years

"These measures will lower the refinancing hump after the program period and improve the prospects for regaining market access."

"A transfer by member states to Greece of amounts equivalent to the income stemming from the SMP portfolio accruing to their national central banks."

"The Eurogroup wants to stress, however, that the above mentioned benefits and initiatives will accrue to Greece in a phased manner and conditional upon a strong implementation by the country of the agreed reform measures in the program period as well as the post-program surveillance period.

"Jointly, all the initiatives decided on today will bring Greece's public debt clearly back on a sustainable path throughout this and the next decade and will facilitate a gradual return to market financing.

Asian shares, euro rise on Greek debt deal

TOKYO (Reuters) - The euro hit a one-month high, commodities rose and Asian shares climbed for a seventh consecutive day on Tuesday as global lenders reached a deal on new debt targets for Greece and a political agreement on disbursing the next installment of aid.

European shares will likely track Asian peers higher, with financial spreadbetters predicting London's FTSE 100, Paris's CAC-40 and Frankfurt's DAX to open as much as 0.7 percent higher.

U.S. stock futures were up 0.3 percent, hinting at a firm Wall Street open.

After 12 hours of talks at their third meeting in as many weeks, Greece's international lenders agreed on a package of measures to cut Greek debt to 124 percent of gross domestic product by 2020, and pledged to take further steps to lower the debt below 110 percent of GDP in 2022.

Eurogroup Chairman Jean-Claude Juncker said ministers would formally approve the release of crucial aid for debt-stricken Greece, removing uncertainty over whether Athens could avoid a near-term bankruptcy.

MSCI's broadest index of Asia-Pacific shares outside Japan gained 0.7 percent to a near three-week high, led by a 1 percent advance in Korean shares and a 0.7 percent rise in Australian shares. The Sensex also jumped 1.2 percent.

Shanghai shares bucked the trend to fell 1 percent to their lowest since 2009, dragged by weakness in growth-sensitive companies.

"Overhanging the market for a little while has been these macro concerns, so progress towards sorting the situation out gives room for the market to move higher," said Phillip Weinberg, director at BestEx.

Investors' focus is likely to shift now to another major concern hanging over markets, a looming U.S. fiscal crisis.

Republicans in the U.S. Congress on Monday called on President Barack Obama to detail long-term spending cuts to help solve the country's fiscal crisis, while holding firm against the income tax rate increases for the wealthy that Democrats seek.

"Now people will start focusing on the U.S. fiscal cliff and there could be some nervousness there, particularly if it drags on," said Burrell & Co dealer Jamie Elgar of Australian shares.

The euro gained as much as about 0.3 percent to $1.3010, its highest level since October 31, in reaction to the Greek news, before paring gains to be up 0.1 percent at $1.2982.

"The euro gained but the rise is small, and it's unlikely that it will climb further, with big funds winding down their positions ahead of the year-end. Any rise will be countered by selling to cap the euro's upside," said Hiroshi Maeba, head of FX trading Japan for UBS in Tokyo.

He cautioned that the euro still faced downside risks as the latest agreement does not offer a fundamental resolution to the euro zone's debt crisis.

"While the Eurogroup has set December 13 for formal approval of the disbursement, and Germany's planned parliamentary vote later this week will be watched with interest, for markets the deal should put Greece largely on the backburner for a couple of months before it starts missing its fiscal targets again," Sean Callow, senior currency strategist at Westpac bank in Sydney, said in a note.

He doubted if the euro's short-covering will produce sustained trade beyond $1.3050/$1.3100.

Japan's Nikkei stock average rose 0.5 percent, just below Monday's seven-month closing high. The benchmark has climbed more than 8 percent in two weeks as the yen has weakened on expectations of easier monetary policy with the likely election of a new government.

WEAK USD, CHINA HELP COMMODITIES

The dollar inched up 0.2 percent against the yen to 82.22 yen. The euro rose 0.3 percent against the yen to 106.72.

Traders said some investors unwound long positions in the dollar built up in recent weeks on expectations the Bank of Japan would come under pressure for more aggressive easing.

The dollar eased 0.1 percent against a basket of key currencies, helping to underpin dollar-based commodities.

U.S. crude futures rose 0.3 percent to $88.03 a barrel and Brent was up 0.2 percent to $111.09.

Spot gold was up 0.1 percent to $1,749.65 an ounce, just below a six-week high of $1,754.10 hit on Friday.

London copper hit a near one-month high of $7,821.50 a tonne as the Greek debt deal added to confidence over copper demand after recent positive data from its top consumer China.

Sentiment may be further underpinned by a report saying China has approved construction of two city subway projects worth 49 billion yuan, adding to the list of recent railway project approvals aimed at boosting growth in the world's second-biggest economy.

In another possible sign that the economy is regaining traction, China's industrial profits in October were up 20.5 percent from a year earlier, accelerating from 7.8 percent growth in September.

Asian credit markets firmed slightly, narrowing the spreads on the iTraxx Asia ex-Japan investment-grade index by 1 basis point.

Silicon Valley's dirty little secret: Age bias

SAN FRANCISCO - When Randy Adams, 60, was looking for a chief-executive officer job in Silicon Valley last year, he got turned down from position after position that he thought he was going to nail ? only to see much younger, less-experienced men win out.?

Finally, before heading into his next interview, he shaved off his gray hair and traded in his loafers for a pair of Converse sneakers. The board hired him.?

"I don't think I would have been able to get this CEO job if I hadn't shaved my head," says Adams, who has founded eight venture-backed companies. He is now chairman of the company that hired him, mobile conference-call service Socialdial, and is fundraising for a new business. Adams has supplemented his makeover by trading in his button-down shirts for T-shirts, making sure he owns the latest gadgets, and getting an eyelid lift.?

Such are the pressures in Silicon Valley, where the startup ethos extols fresh ideas and young programmers willing to toil through the night. Chief executives in their 20s, led by Facebook founder Mark Zuckerberg, are lionized, in part because of their youth. Many investors state bluntly that they prefer to see people under 40 in charge.?

Yet the youth worship undercuts another of Silicon Valley's cherished ideals: that anyone smart and driven can get ahead in what the industry likes to think of as an egalitarian culture. To many, it looks like simple age discrimination -- and it's affecting people who wouldn't fit any normal definition of old.?

"I don't think in the outside world, outside tech, anyone in their 40s would think age discrimination was happening to them," says Cliff Palefsky, a San Francisco employment attorney who has fielded age-discrimination inquiries from people in their early 40s. But they feel it in the Bay Area, he said, and it's "100 percent due to the new, young, tech startup mindset."?

Regional data on age discrimination are hard to come by, making it hard to establish precisely how Silicon Valley stacks up against other parts of the United States.?

Of the 18,335 employment cases filed in 2010 with California's Department of Fair Employment and Housing, one-fifth cited age. That puts age below retaliation as a discrimination claim, but above racial discrimination, sexual harassment, and sexual orientation.?

Nationally, retaliation is also the most frequently cited discrimination claim, according to the federal Equal Opportunity Employment Commission. But age comes much lower down on the national list, below race, sex, and disability.?

The federal agency says age is cited in 26 percent of total complaints in California, compared to 22 percent in New York and 21 percent in Texas. Among large states, Illinois had the highest ratio of age-related complaints, at 37 percent.?

Wunderkind?wanted?
Some technology recruiters say unequivocally they see bias at work. Marta Fuentealba, a principal at startup specialist Talent Farm, says she's encountered it many times.?

She recalls a meeting at a software company a few years ago, when the human-resources executive told her he would like to find somebody "around age 26 or so" to fill a job. An age requirement along those lines would violate both state and federal laws on discrimination, California labor lawyers say.?

"You mean, somebody less jaded?" Fuentealba recalls asking, hoping to jolt the executive back into legal territory. "And he said, ?No, I mean somebody young, probably no older than 26.'" Back at the office, she sent the executive resumes from a variety of candidates.?

Jeff Spirer, a 61-year-old technology marketing and strategy veteran, landed a new job in October after a stint doing part-time consulting. It was a tough search. He recalls the followup after a long phone interview at a small online-surveys company last year.?

The hiring manager asked Spirer to come in for an interview with the chief executive, who was in his 20s. When Spirer walked into the room, the CEO looked at him, said something had come up unexpectedly, and left.?

The interview never got rescheduled, and a younger candidate eventually got the job. Spirer cannot say for sure, but he thinks the CEO was taken aback to see somebody with wrinkles. "What other conclusion can I draw?" asks Spirer.?

Age discrimination is notoriously difficult to prove. Lawyers say they typically do not have smoking guns such as emails saying the candidate or employee is too old, and need to be able to show through other methods such as statistics that the company is making employment decisions based on age.?

In some cases, there are reasons other than bias for preferring younger workers in a startup setting. People with young children can be strapped for time and less able to work long, late hours. Younger workers are more likely to be expert in the newest software programming protocols. Young entrepreneurs, like many others, often move instinctively in hiring from the cohort of those they know.?

Yet there are some indications that age bias is now part of the culture in Silicon Valley --?especially visible in what Adams of Socialdial calls the "cachet of the young entrepreneur."?

When young executives like Zuckerberg are successful, their age often gets a lot of attention. Successful older entrepreneurs, on the other hand, take pride in every aspect of their accomplishments -- except their age.?

When the software company Workday went public last month and raised $637 million, little attention was paid to the fact that co-founder and co-CEO David Duffield is 72.?

Sandy Kurtzig founded Ask Computer Systems and its manufacturing software program, Manman, and saw the company through a stock-market listing in 1981. Now, she has raised $10.5 million from Kleiner Perkins Caufield & Byers and others for her new software company, Kenandy. She says she is in her 60s and leaves it at that, explaining, "I don't want to advertise it."?

'Enthusiastic fan'?
Investors, in contrast to employers, are not subject to discrimination laws when deciding whom to fund. And they are among the most outspoken in declaring their age preferences.?

"I am just an incredibly enthusiastic fan of very talented 20-somethings starting companies," Sequoia Capital's Mike Moritz, 58 years old and a top VC, once said at a conference, echoing similar comments he has made over the years. "They have great passion. They don't have distractions like families and children and other things that get in the way of business." He was 49 at the time.?

"Unfortunately, I don't think the quote you have selected is very representative of what I think," Moritz said in an email. He declined to elaborate.?

Khosla Ventures' Vinod Khosla, 57, told conference goers last year that "people over 45 basically die in terms of new ideas."?

Khosla says the line came in the context of a talk where he was discussing the fear many older people have of failure, contrasted with many younger people's experimental bent. "I was encouraging people to try new things that go against conventional wisdom," he says.?

Khosla Ventures invests in several companies with over-45 leaders, including Nu-Tek Salt LLC and its CEO, Tom Manuel.?

Some venture capitalists extend their appreciation of youth to their own partnerships. In June, Benchmark Capital's Peter Fenton, 40, told a group of journalists that Benchmark strives to keep the average age of its most-active partners under 40 to better relate to young entrepreneurs.?

Fenton says he is not ageist, arguing that there is a well-documented relationship between youth and creativity. As for partners such as himself who hit 40, "we have a discipline to try and stay young," he says. "Young at mind."?

Mark Zuckerberg himself once told a class at startup-funding firm Y Combinator that hiring only young people with technical expertise was the best way to found a successful company. "Young people are just smarter," he said. Zuckerberg was 22 at the time. Through a spokeswoman, he declined to comment.?

Yet there is little evidence to support the idea that young people are intrinsically more likely to thrive as entrepreneurs.?

Fluid intelligence, which allows people to think logically and solve problems, does deteriorate with age, behavioral scientists say. But another type of intelligence known as crystallized intelligence, the ability to tap into experience and amassed knowledge, improves somewhat until about age 65.?

The conventional wisdom about young people being more focused on work is itself a stereotype, older executives say.?

Tired old myths?
"I have more time than a 35-year-old with a newborn," says Spirer, the marketing veteran. "And I'm more available. Judgments are made on age-related stuff without thinking it through."?

Laurie McCann, an attorney with retiree lobby AARP, says the technology sector's obsession with fresh ideas and long hours leads people to fall back on easy assumptions about age.?

"That older people can't work that fast," she says. "That they can't think on their feet in order to come up with the ideas." Further assumptions include inability to change on the part of older employees, or to get along with younger people.?

Other fields, such as law, education or healthcare, also value creativity and hard work, she says, but less so than a track record. "Any field where experience is valued, I think you're going to find less instance of discrimination," she says.?

Silicon Valley veterans try to adapt as best they can. Adams of Socialdial ticks off a list of faux pas that he believes peg older jobseekers as outsiders. "You can't have an AOL email," he says. "That's horrible. A Gmail address is okay. What's really cool is an email with your name on it," as part of the domain.?

In person, older job applicants should carry a backpack, not a briefcase, he says. Avoid Blackberries and Dell laptops in favor of Android phones and Apple products. And above all, steer clear of wristwatches, which most younger people have replaced with the clocks on their phones. "The worst would be a gold Rolex," he says. "Tacky, and old."?

Some recommend dressing young. For her first interview at Facebook, 40-something market researcher Sally Sadosky headed to a boutique popular with women 20 years her junior for advice on "something to look hip" and "blend in."?

She ditched her tailored pants and blouses for a dress, tights, and biker boots. She then got second and third interviews and had to come up with more hipster outfits. "I was beginning to sweat," she recalls. She eventually got the position.?

Adams recommends getting rid of gray hair, either through dyes or through shaving, as he did. He also believes in treating wrinkles or other skin-related signs of age. A few years ago, he underwent an eyelid lift to reduce sagging above his eyes.?

The cosmetic surgery route seems increasingly common among the men of Silicon Valley. Roy Hong, chairman of the Palo Alto Medical Foundation's plastic surgery department, says men represented 14 percent of his customers last year, up from 9 percent a decade ago.?

Still, the scalpel is where some draw the line. Spirer complains that his friend Adams, buoyed by eye-surgery success, is hounding him to undergo a similar procedure for a more youthful image and enhanced job prospects.?

No go. "I'm Jewish," Spirer says. "I've had bags under my eyes since I was 25."?

The Spanish region of Catalonia had an election today, which was seen as a quasi-referendum on independence, which is an aspiration of many in the wealthy Spanish region.

The basic gist is that pro-separatist parties did well, but the main party, which had run on a platform of moving forth with a real independence referendum, did very poorly.

That subtlety is resulting in very different takes across media.

For example, Reuters declares that the separatists had a big day.

FT declares that the region took a step towards independence, and that it's a major blow to Rajoy.

And WSJ declares that voters also strongly endorsed autonomy.

Now compares that to big Spanish media. It's instead focusing on how the election was a disaster for the main party, lead by Artur Mas, which lead votes.

Note that it's not just national media declaring it a Mas defeat.

Regional media is seeing it the similarly.

Here's another Catalan outlet, declaring a "stumble" for Mas.

So the world sees a strong showing for separatists overall, while Spanish media focuses on Mas's specific setbacks.

Either way, it may be awhile before the political ramifications totally shake out, and it's unclear yet what this means for Spanish PM Rajoy, and whether he has the political capital to ask for a bailout.

HP investor sues company for handling of 2 deals

(AP) ? Hewlett-Packard now has a legal headache to compound its misery as the company tries to recover from a series of setbacks that have hammered its stock price and raised doubts about its future.

An HP stockholder who owns 200 shares is suing the company in a complaint that alleges management concealed problems in two key acquisitions that have turned into financial albatrosses.

The lawsuit filed Monday in a San Francisco federal court comes after Hewlett-Packard Co. stunned Wall Street last week with its own allegations of accounting shenanigans at Autonomy, a business software maker acquired for $10 billion last year. HP referred its findings about the alleged fraud to securities regulators in the U.S., and the United Kingdom, where Autonomy was based before the acquisition.

Other shareholder lawsuits are likely as investors try to recover some of the wealth that has evaporated since HP replaced Mark Hurd as its CEO in August 2010.

The revelations of a suspected accounting scandal within Autonomy caused already skittish investors to dump HP's stock. HP had already been losing favor because its personal computer and printer businesses have been faltering as more people buy smartphones and tablet computers.

To make matters worse, HP disclosed in August that its $13 billion acquisition of technology consulting service Electronic Data Systems wasn't working out as well as management envisioned.

The trouble in Autonomy and EDS has forced HP to absorb nearly $17 billion in accounting charges in the past two quarters, resulting in the biggest losses in the company's 73-year history. The Autonomy deal was negotiated while HP was being run by Leo Apotheker, who was ousted 14 months ago. The EDS acquisition closed in 2008 when Hurd was still in charge.

Monday's lawsuit filed by shareholder Allen Nicolow also alleges that HP knew that the EDS and Autonomy deals were duds long before management acknowledged the problems. The complaint alleges HP's management tried to whitewash things in an attempt to prop up the company's stock price.

HP, which is based in Palo Alto, Calif., declined to comment on the lawsuit.

HP's shares closed Monday at $12.74, leaving them worth less half their value at the beginning of the year. The shares peaked this year at $30 in February. Nicolow bought 200 shares of HP stock at $21.87 in May, leaving him with a paper loss of about $1,900 at Monday's close.

Nicolow's lawyers are hoping to get the lawsuit certified as a class-action representing all HP shareholders who bought the company's stock between Aug. 19, 2011 and Nov. 20 this year.

The lawsuit seeks unspecified damages from the company, Apotheker and current HP CEO Meg Whitman. Catherine Lesjak, HP's chief financial officer, and James Murrin, the company's chief accounting officer are also named as defendants.

In statements last week, Whitman said HP didn't learn about Autonomy's alleged accounting ruse until a whistleblower alerted her after she replaced Autonomy CEO Mike Lynch in May. Lynch maintains Autonomy did nothing wrong and that HP came up with the allegations of deceptive accounting to cover up the damage caused by its own bad management.

Samsung wins U.S. court order to access Apple-HTC deal details

SAN FRANCISCO (Reuters) - A U.S. judge has ordered Apple Inc to disclose to rival Samsung Electronics details of a legal settlement the iPhone maker reached with Taiwan's HTC Corp, including terms of a 10-year patents licensing agreement.

The Korean electronics giant had earlier filed a motion to compel its U.S. rival -- with whom it is waging a bitter legal battle over mobile patents across several countries -- to reveal details of the settlement that was reached on November 10 with HTC but which have been kept under wraps.

In August, the iPhone maker won a $1.05 billion verdict against Samsung after a U.S. jury found that certain Samsung gadgets violated Apple's software and design patents.

Now, legal experts say the question of which patents are covered by the Apple-HTC settlement, and licensing details, could be instrumental in Samsung's efforts to thwart Apple's subsequent quest for a permanent sales ban on its products.

The Asian company has argued it is "almost certain" that the HTC deal covers some of the same patents involved in its own litigation with Apple.

The court on Wednesday ordered Apple to produce a full copy of the settlement agreement "without delay", subject to an Attorneys-Eyes-Only designation.

Representatives for the U.S. company could not immediately be reached for comment.

Samsung also requested the California court to add three newly released Apple products -- the iPod Touch 5, the iPad 4 and the iPad mini -- to the list of devices that it claims to have infringed on some of its patents, according to court documents.

The settlement of Apple and HTC ended their worldwide litigation and brought to a close one of the first major flare-ups in the global smartphone patent wars.

Apple first sued HTC in 2010, setting in motion a legal conflagration that has since circled the globe and engulfed the biggest names in mobile technology, from Samsung to Google Inc's Motorola Mobility unit.

ScienceDaily (Nov. 21, 2012) ? A new study looking at the structure of feathers in bird-like dinosaurs has shed light on one of nature's most remarkable inventions -- how flight might have evolved.

Academics at the Universities of Bristol, Yale and Calgary have shown that prehistoric birds had a much more primitive version of the wings we see today, with rigid layers of feathers acting as simple airfoils for gliding.

Close examination of the earliest theropod dinosaurs suggests that feathers were initially developed for insulation, arranged in multiple layers to preserve heat, before their shape evolved for display and camouflage.

As evolution changed the configuration of the feathers, their important role in the aerodynamics and mechanics of flight became more apparent. Natural selection over millions of years ultimately modified dinosaurs' forelimbs into highly-efficient, feathered wings that could rapidly change its span, shape and area -- a key innovation that allowed dinosaurs to rule the skies.

This basic wing configuration has remained more or less the same for the past 130 million years, with bird wings having a layer of long, asymmetrical flight feathers with short covert feathers on top. They are able to separate and rotate these flight feathers to gain height, change direction and even hover.

This formation allows birds to move in such a way as to produce both lift and thrust simultaneously -- a capability that man, with the help of technology, is still trying to successfully imitate.

The research, published November 21 in Current Biology, looked at the dinosaur Anchiornis huxleyi and the Jurassic bird Archaeopteryx lithographica. The latter is 155 million years old and widely considered to be the earliest known bird, presenting a combination of dinosaur and bird characteristics.

Their wings differed from modern day birds in being composed of multiple layers of long feathers, appearing to represent early experiments in the evolution of the wing. Although individual feathers were relatively weak due to slender feather shafts, the layering of these wing feathers is likely to have produced a strong airfoil.

The inability to separate feathers suggests that taking off and flying at low speeds may have been limited, meaning that wings were primarily used in high-speed gliding or flapping flight.

Dr Jakob Vinther, from the University of Bristol's Schools of Biological and Earth Sciences, said: "We are starting to get an intricate picture of how feathers and birds evolved from within the dinosaurs. We now seem to see that feathers evolved initially for insulation. Later in evolution, more complex vaned or pinnate feathers evolved for display.

"These display feathers turned out to be excellent membranes that could have been utilised for aerial locomotion, which only very late in bird evolution became what we consider flapping flight. This new research is shedding light not just on how birds came to fly, but more specifically on how feathers came to be the way they are today -- one of the most amazing and highly specialised structures in nature."

Dr Nicholas Longrich of Yale University added: "By studying fossils carefully, we are now able to start piecing together how the wing evolved. Before, it seemed that we had more or less modern wings from the Jurassic onwards. Now it's clear that early birds were more primitive and represented transitional forms linking birds to dinosaurs. We can see the wing slowly becoming more advanced as we move from Anchiornis, to Archaeopteryx, to later birds."

Research shows telomere lengths predict life expectancy in the wild

Researchers at the University of East Anglia have found that biological age and life expectancy can be predicted by measuring an individual's DNA.

They studied the length of chromosome caps - known as 'telomeres' - in a 320-strong wild population of Seychelles Warblers on a small isolated island.

Published today in Molecular Ecology, their research shows that individuals differ radically in how quickly their telomeres shorten with age, and that having shorter telomeres at any age is associated with an increased risk of death. Telomere length is a better indicator of future life-expectancy than actual age and may, therefore, be an indicator of biological age.

The 20-year research project is the first of its kind to measure telomeres across the entire lifespan of individuals in a wild population.

Telomeres are found at the end of chromosomes. They act as protective caps to stop genes close to the end of the chromosome degenerating ? like the hard plastic ends of a boot lace.

Lead researcher Dr David S Richardson said: "Over time these telomeres get broken down and become shorter. When they reach a critical short length they cause the cells they are in to stop functioning. This mechanism has evolved to prevent cells replicating out of control ? becoming cancerous. However the flip side is that as these zombie cells build up in our organs it leads to their degeneration - ageing - and consequently to health issues and eventually death.

"Telomeres help safeguard us from cancer but result in our ageing."

Researchers studied the warbler population on Cousin Island. Blood samples were collected twice a year and telomere length analysed.

"We wanted to understand what happens over an entire lifetime, so the Seychelles Warbler is an ideal research subject. They are naturally confined to an isolated tropical island, without any predators, so we can follow individuals throughout their lives, right through to old age.

"We investigated whether, at any given age, their telomere lengths could predict imminent death. We found that short and rapidly shortening telomeres were a good indication that the bird would die within a year.

"We also found that individuals with longer telomeres had longer life spans overall.

"It used to be thought that telomere shortening occurred at a constant rate in individuals, and that telomere length could act as an internal clock to measure the chronological age of organisms in the wild.

"However while telomeres do shorten with chronological age, the rate at which this happens differs between individuals of the same age. This is because individuals experience different amounts of biological stress due to the challenges and exertions they face in life. Telomere length can be used as a measure of the amount of damage an individual has accumulated over its life.

"We saw that telomere length is a better indicator of life expectancy than chronological age - so by measuring telomere length we have a way of estimating the biological age of an individual ? how much of its life it has used up."

The research is important because while these ideas have been researched in the lab, they have never been tested in a wild environment.

"It would be virtually impossible to do such a study in humans," said Dr Richardson. "For one thing it would take a very long time to study a human lifespan. Also in humans we would normally, quite rightly, intervene in cases of disease, so it wouldn't be a natural study.

"We found that telomeres are linked to body condition and reflect the history of oxidative stress that has occurred within an individual's lifetime. The healthier you are, or have been, the better telomeres you have. But it's hard to know whether this is a consequence of being healthy, or a cause.

"Oxidants attack telomeres. So things like smoking, eating foods that are bad for you, and putting your body through extreme physical or mental stress all have a shortening affect on telomeres.

"All these stresses do damage to our bodies. You hear people saying 'oh they look like they've had a hard life'. This is why. A shortened telomere shows an accumulation of damage life has done to you."
